Work on a rest day

Article 14

A) Dayworkers

  1. An employee whose normal working hours are spread over 5 days including Saturday or Sunday and who is required to work on his rest day, shall be paid double-time for all hours worked on such day subject to a minimum payment of 2 hours at double-time.
  2. Where an employee has 2 days off as part of the working arrangement other than a Saturday or Sunday, one of the days shall be designated as a rest day and the other as a free day and an employee required to work on the free day shall be entitled to:
    1. normal overtime arrangements if he is informed before leaving work at the end of the previous day
    2. recall arrangements if called upon to return to work when notice is not given before leaving work at the end of the previous day.
  3. Where a public or extra-statutory holiday coincides with a rest day or free day, the day shall be treated as a public or extra-statutory holiday and in addition, a substitute rest day or free day will be given.

B) Shift Workers

  1. If a shift worker is called upon to work on his normal rest day, he shall be paid for the hours worked at the rate of double-time, subject to a minimum payment of two hours at double-time.
  2. Where a shift worker has 2 days off as part of the working arrangement, one of the days shall be designated as a rest day. If one of the days is a Sunday, that day shall be the rest day. The other day off shall be regarded as a free day and if an employee is required to work on that day:
    1. payment at the rate of time-and-one-half shall be made if he is informed before leaving work at the end of the last normal shift
    2. arrangements for employees called upon to return to work shall apply if notice is not given before leaving work at the end of the last normal shift
  3. Where a public or extra-statutory holiday coincides with a rest day or free day, the day shall be treated as a public or extra-statutory holiday and in addition, a substitute rest day or free day shall be given.
  4. The provisions of (B)(ii)(a) above shall not apply to work performed by airport firefighters at Ronaldsway in connection with training exercises involving the use of the inshore rescue boat where, in recognition of the danger involved, payment for all the hours of attendance on such exercises will be made at double time rate.

The provisions of this Article do not apply to:

  1. Leisure Group Workers within the Department of Economic Development (VMGT) and Department of Education and Children (NSC) who have separate arrangements.
  2. Heritage Railway Staff employed by the Department of Infrastructure are covered by a local agreement dated 27 July 2015 (under review).
